PRAYAGRAJ: The Allahabad HC on Monday disposed of two separate petitions filed by the UP Sunni Waqf Board and Shahi Eidgah Trust and sent the matter on Mathura title suit back to the trial court, Mathura, with directions to adjudicate the civil suit no. 353 of 2022 relating to this issue.
In its interim order dated August 3, 2022, the HC had stayed the proceedings before the trial court. With the present order, that stay stands vacated and the trial court in Mathura will hear the Katra Keshav Dev Temple-Shahi Masjid Eidgah land dispute. “All parties are free to raise all their contentions before the trial court at Mathura,” Justice Prakash Padia said. The court observed, “Any observations by this court will prejudice the rights and contentions of both the parties.”
The two Muslim sides had challenged the May 19, 2022 order by the district judge, Mathura, directing the trial court to hear all the parties concerned and pass an order in the suit filed by the petitioner deity to remove the Shahi Eidgah Masjid.
